Part I. The scope of application
The entity responsible for the collection, processing and use of personal data within the meaning of the European Union General Data Protection Regulation (GDPR) is Dito Gear. As a responsible entity, Dito Gear is available under the following contact details:

The user may at any time obtain free information about his data that is stored with us, as well as use his right to correct, block or delete his data. To do this, use the contact details listed above.
If you do not agree to the processing or use of your data by Dito Gear according to these data protection provisions in whole or in relation to individual activities, you may submit your objection by e-mail or letter using contact details listed above.
Part II. Most frequent activities on Users’ personal data
Below we describe the most frequently occurring activities on Users’ personal data, regarding the use of Dito Gear services
Customer Account For each customer who registers at Dito Gear website using the “register” function, we create a customer account, i.e. password-protected, direct access to his or her existing data stored by us. This allows the user, amongst other things, to view his or her orders, create a wish list, add an address for the delivery purposes or to manage their personal data and the newsletter.
The following data must be given during the registration for a customer account (obligatory disclosures):
– e-mail address
– First name
– Last name
– consent to the data-protection provisions
Your invoice and delivery address need not to be given unless you order something. For your order Dito Gear needs your correct name, address and the telephone number. We need your e-mail address so that we can confirm receipt of your order and its dispatch, and so that we can communicate with you in general. We also use your e-mail address to identify you (as a log-in name), when you visit your customer account.
Transactions: We collect, store and process your data for the entire processing of your purchase, including any subsequent warranty claims, the technical administration, our own marketing purposes and to prevent criminal offences and fraud. Your personal data is only passed on to third parties to the extent that this is legal, including the purpose of processing the purchase, for invoicing and for marketing purposes. When processing orders, for example, the service companies used by us (logistics companies, banks) are sent the data they require for processing and concluding orders. The data passed on to our service providers in this context may only be used by them for fulfilling their duties.
User Service: Dito Gear collect, store and analyze personal data of Users who contact User service department. These data may be necessary to communicate with the User (e.g. to answer the questions asked by him), but also to fulfill his request. The contact will also be possible through the use of data placed for this purpose on the User’s Account. If it is allowed under the applicable law, Dito Gear will also be entitled to obtain and store other personal data regarding communication with Users, e.g. information about requests for support or feedback from Users.
Contact form: Dito Gear may collect personal data of Users contacting Dito Gear through the available tools, including the contact form available on DitoGear website and at the DitoGear Store. These data are necessary to enable Dito Gear to contact Users.
Use of Your Data for Advertising Purposes: Apart from the processing of your data for concluding your purchase at Dito Gear, we also use your data for the following purposes:
– to permanently improve your purchase experience;
– to communicate with you about your orders, and about certain products or marketing campaigns.
To this end we use the information available, such as information on the terminal device used by you, your connection to the Internet, operating system and platform, date and time of the visit to the home page, or products that you have looked at, as well as information that we have received from you (including automatically transferred or generated information). Apart from this, we also make use of your order history. The utilization of your personal data for advertising purposes can be objected to at any time, whether all-in-all or as regards individual measures, without any costs. Notification in text form sent by one of the contact options given under point 1 (e.g. e-mail or letter) is sufficient for this purpose.
Newsletter: For sending the Newsletter we make use of the e-mail address given by you and for this we need your confirmation that, as the owner of the e-mail address, you consent to its receipt . Whenever you decide that you no longer want to receive a newsletter from us, you can object to this at any time without any costs. Notification in text form sent by one of the contact options given under point 1 (e.g. e-mail, letter) is sufficient for this purpose. There is, of course, also a cancellation link in every newsletter.
Banner Ads: We also use the data collected during your visit to show you so-called banner ads. These are advertisements which we also use on third-party sites. It usually involves the use of so-called cookies or pixels. Our aim here is to make the advertising offers more useful and more interesting for you, which is why you will see, in the context of the banner ads, mainly products that you have either already looked at on our site or products that are similar to those already looked at by you (so-called re-targeting). Within the framework of the banner ads we work solely with pseudonymous data; clear-text information relating to your person (e.g. your name or your e-mail address) is not used in the cookies.
Cookies: Like many other websites offering very different services provided electronically, Dito Gear may collect data as part of the Dito Gear services via technologies such as cookies, tracking pixels and objects shared locally (e.g. in a browser or on a device).
A cookie is a small file which asks permission to be placed on your computer’s hard drive. Once you agree, the file is added and the cookie helps analyse web traffic or lets you know when you visit a particular site. Cookies allow web applications to respond to you as an individual. The web application can tailor its operations to your needs, likes and dislikes by gathering and remembering information about your preferences.
We use traffic log cookies to identify which pages are being used. This helps us analyse data about web page traffic and improve our website in order to tailor it to customer needs. We only use this information for statistical analysis purposes and then the data is removed from the system. Overall, cookies help us provide you with a better website, by enabling us to monitor which pages you find useful and which you do not. Google Analytics: This website makes use of Google (Universal) Analytics, a web-analysis service from Google Inc. (www.google.com). Google (Universal) Analytics deploys methods that make it possible to analyse the use made of the website by you, e.g. the so-called “cookies”, which are text files that are stored on your computer. The information generated on your use of this website is transmitted, as a rule, to a Google server in the USA and stored there. By activating the IP-anonymize function on this website the IP address is shortened, within the member countries of the European Union or in other contracting states that were party to the agreement on the European Economic Area, before further transfer. Only in exceptional cases is the full IP address sent to a Google server in the USA and shortened there. The anonymized IP address transferred by your browser within the framework of Google Analytics is not brought together with other Google data. You can prevent the acquisition of the data generated by the cookie and relating to your use of the website (incl. your IP address) by Google, as well as its processing by Google, in that you download and install the browser plug-in available under the following link: http://tools.google.com/dlpage/gaoptout?hl=en.
Part III. Use of collected data
Dito Gear processes (e.g. collects, stores, analyzes, etc.) Users’ personal data for the following purposes:
- in order to register an account with us based on your consent;
- in order to prepare a quote for you and then conclude the agreement with you based on your interest in our offer;
- in order to service the payment transaction for your order, which is our legally justified interest;
- in order to execute the agreement with you for the product or service that you have ordered;
for archival purposes (evidence) to secure information in a legal case, which is our legally justified interest;
- in order to determine, investigate or defend against claims, which is our legally justified interest;
- in order to handle the requests (for support, for information about the products, for warranty claims) you send to us;
- in order to send you our marketing offers and newsletters based on your consent;
- in order to contact you for the purposes of handling your request.
Dito Gear is authorized to store data collected and tracked on the Dito Gear sites only in the scope of implementation of the aforementioned business objectives.
Part IV. Data sharing
We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others rights, property, or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.
In particular: Dito Gear does not transfer Users’ personal data to third parties without the consent of the Users concerned, unless one of the following circumstances occurs:
- Dito Gear may provide anonymised data (i.e. those that do not identify specific Users) to external service providers, trusted partners or research agencies in order to better recognize the attractiveness of advertising and services for Users, improve the overall quality and efficiency of services provided by Dito Gear or entities or participation in scientific research that generates a broadly understood social benefit.
California Online Privacy Protection Act Compliance
Because we value your privacy we have taken the necessary precautions to be in compliance with the California Online Privacy Protection Act. We therefore will not distribute your personal information to outside parties without your consent.
Children’s Online Privacy Protection Act Compliance
We are in compliance with the requirements of COPPA (Childrens Online Privacy Protection Act), we do not collect any information from anyone under 13 years of age. Our website, products and services are all directed to people who are at least 13 years old or older.
Part V. Your rights related to the processing of personal data
You have the following rights in connection with the processing of your personal data by us:
- the right to access your data and receive a copy thereof,
- the right to rectify (amend) your data,
- the right to delete data or limit data processing,
- the right to object to data processing,
- the right to transfer data,
- the right to withdraw consent to the processing of data without affecting the lawfulness of the processing carried out prior to such withdrawal, which means that the withdrawal of consent is not retroactive,
- the right to lodge a complaint to the supervisory body – the Inspector General for Personal Data Protection or the body that is his successor.
- If your data is processed on the basis of your consent, you can also use the following rights:
- the right to withdraw consent in the scope in which they are processed on this basis. Withdrawal of consent does not affect the lawfulness of the processing that was made on the basis of consent before its withdrawal.
- If your data is processed on the basis of consent or as part of the service provided (data is necessary to provide the service) you can additionally use the following rights:
- the right to transfer personal data, i.e. to receive from the administrator your personal data, in a structured, commonly used, machine-readable format. You can send this data to another data administrator.

Part VI. Security
We implement a variety of security measures to maintain the safety of your personal information when you place an order or enter, submit, or access your personal information.
We offer the use of a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment gateway providers database only to be accessible by those authorized with special access rights to such systems, and are required to keep the information confidential.
After a transaction, your private information (credit cards, social security numbers, financials, etc.) will not be stored on our servers.
